Local Law 11, officially the Facade Inspection & Safety Program (FISP), requires owners of NYC buildings taller than six stories to have their exterior walls inspected every five years. Cycle 10 is now underway. Here is what you need to know.
Cycle 10 filing windows
Your filing window depends on the last digit of your building’s tax block number:
- Sub-cycle 10A (block ends in 4, 5, 6 or 9): February 21, 2025 – February 21, 2027
- Sub-cycle 10B (block ends in 0, 7 or 8): February 21, 2026 – February 21, 2028
- Sub-cycle 10C (block ends in 1, 2 or 3): February 21, 2027 – February 21, 2029
If you are in 10A, your deadline is now only a few months away.
Safe, SWARMP and Unsafe
A Qualified Exterior Wall Inspector (QEWI), who is a licensed engineer or architect, inspects the facade and files a report with the Department of Buildings. Each facade is classified as:
- Safe: no repairs needed right now.
- SWARMP (Safe With a Repair and Maintenance Program): repairs must be made before the next cycle, or the condition can become Unsafe.
- Unsafe: the owner must protect the public right away, usually with a sidewalk shed, and make repairs promptly.
Penalties for missing deadlines
- Late filing: $1,000 per month
- Failure to file: $5,000 per year
- Failure to correct SWARMP conditions: $2,000
- Failure to correct Unsafe conditions: penalties set case by case
On top of penalties, every month a sidewalk shed stays up costs money. Fast, well-planned repairs are the cheapest way through a FISP cycle.
